Terms of Service

Effective date: June 18, 2026

By using PhotoRizz ("the app"), you agree to these terms. If you do not agree, do not use the app. PhotoRizz is operated by Stanley Hung, a sole proprietor based in Ontario, Canada ("we", "our").

1. Service Description

PhotoRizz is an AI-powered tool that generates realistic profile photos from a photo of your face that you upload, designed for dating, professional, and social profiles. The service requires an account and uses one-time photo credits for generation.

2. Eligibility

You must be at least 18 years old to use PhotoRizz. By creating an account, you confirm you are 18 or older.

3. Your Account

• You are responsible for maintaining the security of your account.
• You must provide accurate information when creating your account.
• You may delete your account at any time from the Settings screen.

4. Acceptable Use

PhotoRizz generates realistic images of a person's face, so responsible use is essential. You agree that you will not:

• Upload a photo of anyone other than yourself unless that person is an adult who has personally given you permission.
• Upload photos of minors (anyone under 18), or generate any image depicting a minor.
• Upload photos of public figures, celebrities, or any person without their consent.
• Create images that impersonate someone, deceive others about identity, or place a real person in a false, misleading, or defamatory light ("deepfakes").
• Upload or generate illegal, sexually explicit, hateful, harassing, or otherwise harmful content.
• Attempt to manipulate, reverse-engineer, circumvent, or abuse the AI generation system, its safety filters, or its usage limits.
• Resell or commercially redistribute generated images, or use the service to build a competing dataset or model.

You are solely responsible for the photos you upload and for how you use the images you generate.

5. Your Content & AI Output

• Your photos. You retain ownership of the photos you upload. You grant us a limited licence to store and process them (including sending them to our AI provider) solely to provide the service to you.
• Your representations. You represent and warrant that you have all rights and consents necessary to upload each photo and to have it processed as described in our Privacy Policy.
• Generated images. Subject to your compliance with these terms, you receive a licence to use the images you generate for personal purposes, including dating, professional, and social profiles. We do not guarantee the quality, accuracy, realism, or suitability of any generated image, and generated photos may not perfectly represent reality.

6. Photo Credits

• Photo generation consumes credits, which are purchased as one-time packages through the Apple App Store or Google Play Store. PhotoRizz does not offer subscriptions.
• New users receive a one-time welcome bonus of credits.
• You may also earn occasional free credits by choosing to watch a rewarded advertisement; this feature is optional.
• Credits are consumed when a generation succeeds and do not expire while your account is active. Credits have no cash value and are non-transferable.
• Deleting your account forfeits any remaining credits.

7. Refunds

If a generation fails due to a system error, the credits for that generation are automatically refunded to your balance. Payments for credit packages are processed by Apple or Google; any refund of a purchase is governed by, and must be requested through, the relevant store's policies.

8. Advertising

The app includes an optional feature to watch a rewarded video ad in exchange for a free photo credit. Ads are served by Google AdMob and are governed by our Privacy Policy. You are never required to watch an ad to use the app.

9. Service Availability

We aim to keep the service available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue the service with reasonable notice.

10. Limitation of Liability

PhotoRizz is provided "as is" and "as available." To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the service, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

11. Indemnification

You agree to indemnify and hold harmless PhotoRizz and its operator from any claim or demand arising out of the photos you upload, the images you generate, or your breach of these terms — including any claim that your upload or use infringed someone's rights or was made without their consent.

12. Termination

We may suspend or terminate your account if you violate these terms. You may terminate your account at any time by deleting it from Settings.

13. Governing Law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. Before bringing any formal claim, you agree to first contact us at photorizz@staim.ai and attempt to resolve the matter informally. Nothing in these terms limits any mandatory consumer-protection rights you have under the law of your place of residence.

14. Changes to Terms

We may update these terms. Continued use of the app after changes take effect constitutes acceptance.
